Terms of Service

The Nightly Story Club (the “Service”) is operated by Parker Jane Company LLC (“Parker Jane,” “we,” “us,” or “our”). By creating an account, joining the waitlist, or otherwise using the Service, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.

1. Eligibility & parental responsibility

The Service is intended for adults 18 years or older who are the parent or legal guardian of the child whose profile is created. The Service is not designed for use by children, and children do not create accounts or interact with the Service directly. You are solely responsible for any profile, content, or instructions you submit on behalf of a child in your care, and for deciding whether any story we deliver is appropriate to read to that child.

2. The service

We deliver personalized bedtime story letters by email, generated using artificial intelligence and shaped by the profile information you provide. Stories are intended to be light-hearted, fictional, and age-appropriate, but they are computer-generated creative writing — not professional, educational, medical, psychological, or therapeutic advice. You will always receive each letter before bedtime so you can review it before reading it aloud.

3. AI-generated content & your inputs

Do not enter sensitive, private, or identifying information about your child or any other person into the Service. This includes, without limitation: home address, school name, phone number, government identifiers, health or medical conditions, therapy or counseling notes, financial information, photographs, login credentials, or any information about other people who have not consented. The profile fields (such as first name or nickname, age, favorite things, themes, and things to avoid) are designed to collect only the minimum needed to personalize a story.

You acknowledge that (a) inputs you provide are sent to third-party AI providers to generate stories; (b) AI output can be unexpected, inaccurate, repetitive, or occasionally off-tone despite our content guardrails; and (c) you are responsible for previewing each story before sharing it with a child. We make no guarantee that any specific story will be perfectly aligned with your preferences.

4. Your account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. We may suspend or terminate an account that violates these Terms, abuses the Service, or creates risk for us or other users.

5. Acceptable use

You agree not to: (a) use the Service to generate content that is illegal, harmful, harassing, sexual, exploitative of minors, hateful, or otherwise inappropriate; (b) attempt to bypass our safety filters or content guardrails; (c) reverse engineer, scrape, or interfere with the Service; (d) use the Service to build a competing product; or (e) submit information about a child for whom you are not the parent or legal guardian.

6. Memberships, billing & cancellation

Paid memberships renew automatically on the cadence shown at checkout until cancelled. You can cancel anytime from your account; cancellation stops future renewals and ends story delivery at the close of the current billing period or sooner, at our discretion. Except where required by law, fees already paid are non-refundable. Founding-member pricing, when offered, is locked in for the lifetime of your continuous membership and is lost if your membership lapses.

7. Content & license

Stories delivered to you are licensed for your personal, non-commercial family use. You may print them and read them aloud within your household. You may not republish, resell, redistribute, or use them to train any machine-learning model. We retain all rights in the Service, our prompts, templates, brand, and underlying software.

By submitting profile information, feedback, or other inputs, you grant Parker Jane Company LLC a worldwide, royalty-free license to use that content to operate, secure, support, and improve the Service.

8. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT AI-GENERATED CONTENT WILL MEET YOUR EXPECTATIONS. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE DELIVERY.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKER JANE COMPANY LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY STORY DELIVERED THROUGH IT. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

10. Indemnification

You agree to indemnify, defend, and hold harmless Parker Jane Company LLC and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) content or inputs you submit, (c) your violation of these Terms, or (d) your violation of any rights of a third party, including the child whose profile you create.

11. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively by binding individual arbitration administered by a recognized U.S. arbitration provider, except that either party may bring an individual claim in small-claims court. You and Parker Jane Company LLC each waive any right to a jury trial and to participate in a class action.

12. Changes

We may update these Terms from time to time. Material changes will be posted on this page with a new “last updated” date, and your continued use of the Service after a change means you accept the updated Terms.
